Anne Pentland Garden will take action on valid DMCA notices of copyright infringement, which may include removing content from our website without prior liability upon receiving a compliant DMCA notice as specified under 17 U.S.C. § 512(c)(3). Notices of infringement should be sent to our designated Copyright Agent. Please note, failure to comply with the requirements of the DMCA may result in an unprocessed notice.
Counter-Notification:
If you believe content was wrongly removed from the website, you can submit a counter-notification to our Copyright Agent under 17 U.S.C. § 512(g)(2) and (g)(3). Upon receiving a valid counter-notification, we may restore the removed content.
A counter-notification must include:
- Identification of the material that has been removed or to which access has been disabled.
- Your contact details: name, address, phone number, email address.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the district where you reside, or if outside the U.S., in any district where Anne Pentland Garden may be found, and that you will accept service from the person who provided the initial notice of infringement or their agent.
- Your physical or electronic signature.
